The four root causes of eDiscovery misconduct are: 1) a general lack of technical sophistication; 2) over-zealous advocacy; 3) neglecting client communication and other professional duties in the case; and 4) legal incompetence. The most egregious offenses usually fall under causes two through four. Sadly the more typical eDiscovery failures that make up most misconduct stem from lawyers’ technological incompetence.

When we have too much or too little energy devoted to one or more Chakra, the sense of feeling fearful, overemotional and indecisive can overcome the normal balance and communication between the mind and body. This unbalance can create nervousness, anxiety, insecurity, insomnia, headaches and confusion. The FDA recently issued a draft guidance document titled “Content of Premarket Submissions for Management of Cybersecurity in Medical Devices.” The draft guidance states that, when finalized, it will replace the final guidance issued in October 2014, with the same name. According to the FDA, “the rapidly evolving landscape, and the increased understanding of the threats and their potential mitigations, necessitates an updated approach.”
