On May 22, the U.S. Supreme Court held that the U.S. Court of Appeals for the Federal Circuit, which handles all patent appeals, has been using the wrong standard to decide where a patent lawsuit can be brought.

In TC Heartland LLC v. Kraft Foods Group Brands LLC, the Supreme Court unanimously held that a domestic corporation resides only in its state of incorporation for patent infringement suits.

In Lee v. Tam, the Supreme Court is deciding whether the disparagement provision of the Lanham Act, 15 U.S.C. 1052(a), which bars registration of marks containing matter that disparages “persons, living or dead, institutions, beliefs, or national symbols, or bring[s] them into contempt, or disrepute,” is facially invalid under the Free Speech Clause of the First Amendment.
