Marie Walsh and Mary White of Hanna Moore + Curley have provided an update to their European Unitary Patent system CLE webinar given in September 2016. The Unified Patent Court (UPC) Preparatory Committee has announced that the UPC can become operational starting December 1, 2017. As a result, the “sunrise period” for opting out of the UPC would start September 1, 2017. Accordingly, patent owners should begin making strategic decisions regarding their patent portfolios and considering which, if any, EP patents to opt out of the UPC.
