Recently, the Indiana Court of Appeals held that uninsured motorist coverage was inapplicable where an insured-passenger was injured in his own vehicle by a tortfeasor operating the insured’s vehicle.

James Harvey was involved in an automobile collision that killed John Potts. After analyzing Mr. Harvey’s exposure, his insurer, GEICO, quickly realized that Mr. Harvey was at fault for the collision and that his $100,000 policy limits were inadequate to compensate Mr. Potts’ widow and three children for their damages. GEICO informed Mr. Harvey that he was potentially underinsured for the collision and tendered his policy limits to Mr. Potts’ estate. Then came the problems.

In Erie Indem. Co. v. Estate of Harris, 99 N.E.3d 625 (Ind. 2018), the Indiana Supreme Court concluded that the phrase “others we protect” in an employer’s commercial auto policy was unambiguous and did not afford coverage to an employee struck by an uninsured motorist while that employee was mowing his lawn on a riding lawnmower.

Previously, we summarized the case law relating to whether a person is an insured under the terms of the policy itself, in a first-party relationship to the contract. In those instances, the insured was either named in the policy or was an insured by definition under that policy based upon a relationship to the named insured. Here, we will examine how a person could be insured under the policy when that person does not meet one of those two previously discussed policy definitions of insured.

An insurance policy is issued by an insurer to a named insured to provide coverage for specified risks of loss and with certain conditions and exclusions.  Insurance policies are a  contract,  and are governed by the same rules of construction as other contracts.
