The EEOC recently obtained a consent decree resolving long-running litigation against Cintas Corporation targeting class-based hiring practices that the Commission alleged discriminated against women. In addition to monetary damages of $1.5 million, the Commission secured significant injunctive relief. Among other things, Cintas must undertake a new validation study to ensure its screening and interviewing criteria do not have an adverse impact against female applicants for service sales representative positions. In addition, the Commission highlighted the Sixth Circuit Court of Appeals' earlier opinion in the case Serrano v. Cintas, 699 F.3d 884 (6th Cir. 2012), which confirmed the Commission's authority to bring pattern-or-practice claims.
