Citing "Advice of Counsel" Has Pitfalls in Decision Making

Attorneys appreciate clients who seek advice proactively, but clients need to fully understand their attorneys' advice. As one client learned, "advice of counsel" is not always the appropriate explanation for a course of action. This post highlights the pitfalls of referring to "advice of counsel" in defending adverse employment actions.
