A recent order entered in the United States District Court for the Southern District of California provides helpful guidance on drafting requests for production under the Federal Rules of Civil Procedure and additional considerations for developing discovery dispute strategies. In this case, the purchaser of a 2013 Ford F-350 truck brought several claims arising from an allegedly defective engine. The purchaser sought to compel production of information in connection with 12 requests for production.

Recently, the United States District Court for the Northern District of Illinois imposed significant sanctions, including a mandatory adverse inference instruction, against a plaintiff that deleted his Facebook account after receiving written discovery requests targeted at the information contained within the Facebook account. This case is a cautionary tale for any practitioner and stands for the proposition that the duty to preserve social media evidence can arise long before suit is filed, even where the evidence on the social media page does not directly relate to the subject matter of the case.

A selection committee acting on behalf of the Indianapolis Bar Association and the Foundation has announced the selection of Chief Judge Tanya Walton Pratt of the U.S. District Court for the Southern District of Indiana as a recipient of the IndyBar's prestigious Luminary Award of Excellence. Chief Judge Pratt will be honored at the 2021 IndyBar Bench Bar Conference in Louisville, Kentucky on June 19.
