UM/UIM Limits May Not Be Setoff by Workers’ Compensation Payments - Insurance Coverage

The Indiana Court of Appeals held that UM/UIM limits may not be set off by workers’ compensation payments made to the policyholder. The court reasoned that the UM/UIM statutory regime is a full recovery, remedial statute, and that reduction of limits for payments other than those by the tortfeasor or someone responsible for the accident are impermissible.
