Insurer's Attorney Acting as Claims Handler Must Sit for Deposition

The 9th Circuit Court of Appeals held that Vizio was not entitled to coverage when it paid a settlement without properly notifying its excess insurer. Without obtaining affirmative prior consent to incur defense charges, Vizio was responsible for its own attorney’s fees and the portion of the settlement that was not covered by other insurance.
