Medical Payments Cannot be Setoff From UM/UIM Limits

The Indiana Court of Appeals held that medical payments cannot be setoff from UM/UIM limits regardless of whether the insurer included a setoff clause in the policy, and that such setoffs are unenforceable pursuant to state statute.
