Easily one of the most litigated area in collections law, the Fair Debt Collections Practices Act (“FDCPA”), 15 USC § 1962 et. seq., can be a legal quagmire for those engaged in debt collection. Under the FDCPA, the term “debt collector” refers to “any person who uses any instrumentality of interstate commerce or the mails in any business the principal purpose of which is the collection of any debts, or who regularly collects or attempts to collect, directly or indirectly, debts owed or due or asserted to be owed or due another” in the personal, family, or household context.

Effective December 1, 2017, amendments to the Federal Rules of Bankruptcy Procedure will require filers to use the national version of a Chapter 13 plan, or a locally adopted version that complies with certain requirements. The Court has decided to continue use of a local version, and has modified the current plan form to satisfy the new requirements. A copy of the plan form is attached. Instructions for submitting comments appear below. Once the plan form is finalized, a fillable version will be made available on the Court’s website.

Hello to all CMB Section Members. I hope 2017 has been a productive and enjoyable year so far for all of you, and it has been a pleasure seeing many of you at the CLE and social events hosted by our Section so far this year.  

The monetary amount was revealed in documents filed in Gawker’s bankruptcy, report the New York Times DealBook blog, LawNewz and the Hollywood Reporter.

LawNewz reports that Hogan will also get a portion of proceeds from the sale of Gawker Media assets to Univision, while the Hollywood Reporter says Hogan will get a share of distributions from “a contingent proceeds creditor account.”

The Judicial Conference Advisory Committees on Appellate, Bankruptcy, Criminal, and Evidence Rules have published proposed amendments to their respective rules and forms, and requested that the proposals be circulated to the bench, bar, and public for comment.

Changes in Indiana law through Senate Enrolled Act 505, provided new recording fees effective July 1, 2017 for all 92 counties. However, the Indianapolis City-County Council was required to adopt an ordinance to maintain predictable recording fees. The Council unanimously passed the ordinance on July 10, 2017 effective August 1, 2017.
