Summary

Addressing title and survey issues in real estate transactions is now more important than ever as lenders and capital sources tighten their underwriting guidelines due to the current economic climate. In this multi-hour CLE, we cover the basics of the current ALTA Survey Standards and ALTA Title Commitments, how attorneys interact with the surveyor and title company in the process of reviewing and resolving identified issues, and take a deeper dive into the complexities of unique title issues involved with construction escrows and mechanics lien underwriting, joint-venture partners, mezzanine financing, and distressed properties in bankruptcy. In the final hour, we cover 1031 like-kind exchanges which can offer your clients a significant tax advantage by deferring capital gains taxes on a sale of investment property by reinvesting in similar property. There are many pitfalls to be aware of and avoid when executing 1031s and this CLE explains the basics of a 1031 exchange, explains the purpose of the exchange, takes you through the time frames involved, and introduces the steps necessary to successfully complete a 1031 exchange.
