Summary

With two pending cases in the U.S. Supreme Court, this is the first time the new five-Justice conservative majority has considered the scope of environmental agencies authority. The decisions in West Virginia v. EPA and Sackett v. EPA are likely to produce new laws rather than the fractured majorities that have defined similar cases in the past. During this program, we give an overview of these cases and their potential implications. Our program occurs after the decision in West Virginia but before the argument in Sackett, giving you the opportunity to see how the courts first decision informs its second.
