There has been a lot of discussion in the legislature and media in the past year about bail and pretrial release. It has resulted in legislation being proposed in the Indiana General Assembly in the form of limitations on release, on the amount of bail and who can post bail on behalf of alleged felons. Most of those bills appear to have stalled in committee. But this is a good time to review the Indiana Supreme Court’s adoption of Indiana Rule of Criminal Procedure Rule 26.
