On Wednesday, Sept. 9, 2020, the House Judiciary Committee passed by voice vote the Trademark Modernization Act, which was introduced in March 2020. Among other things, the Act would codify existing procedures that permit third parties to submit evidence of fraud during trademark examination, and it would create ex parte procedures to cancel registrations for marks that have not been used.

Owners of U.S. trademark applications and registrations are receiving fraudulent emails that appear to originate from the United States Patent and Trademark Office domain, @uspto.gov. These emails are a scam and do not come from the USPTO.

Counterfeiting has always been a matter of grave concern for brand owners, as counterfeit goods can cause lost profits, force brand owners to spend time and money in combatting the importation and sale of the goods, and erode the goodwill associated with a brand.  Equally important, counterfeiting harms the consumers, as products that are not genuine can pose serious health and safety risks. In the midst of the current global health crisis caused by COVID-19, such potential harm has been magnified.

The nomination period has begun for the 2021 Board of Directors of the Indianapolis Bar Association, and Kelley Johnson of the Law Office of Kelley J. Johnson LLP  has been appointed to chair the effort. Johnson, who is a past president of the Indianapolis Bar Foundation, will lead a committee of members in selecting a slate of officers for the coming year.

The Copyright Office is now accepting applications for the Barbara A. Ringer Copyright Honors Program. This fellowship, which runs eighteen- to twenty-four months, was created for attorneys in the initial stages of their careers who demonstrate exceptional ability and interest in copyright law.
