NCAA Files Brief in Johnson v. NCAA - Sports and Entertainment Law News

The NCAA filed its brief in Johnson v. NCAA asking the Third Circuit Court of Appeals to reverse a Pennsylvania district court’s finding that college athletes could be considered employees under the Fair Labor Standards Act, and therefore allowing the case to proceed, based on the Seventh Circuit’s 2016 decision in Berger v. NCAA, the Ninth Circuit’s decision in Dawson v. NCAA, and the US Supreme Court’s decision in the Alston case from 2021.
