IDEM Issues Revised Draft of Risk-Based Closure Guide - Environmental Law News

On July 1, 2021, IDEM released a revised draft of its new Risk-Based Closure Guide, an updated version of the 2012 Remediation Closure Guide, based on an initial round of external comments. IDEM has recently posted several documents for public review, including:

  • Responses to external comments received.
  • Risk-Based Closure Guide draft, dated July 1, 2021.
  • A redline version showing changes to the text originally offered for external comment.

Copies of these documents have been posted here.

As part of the revision process IDEM invited external comments on a preliminary draft in 2020. This invitation to comment was prior to, and in addition to, the forthcoming comment period specified by statute as part of the nonrule policy document (NPD) process. The current draft must undergo further internal review and may change before it is made available for additional public comment as part of the standard NPD process. Note that IDEM is not currently soliciting comments on this draft. Notice of a public comment period for the proposed NPD will appear here.
