Chief Justice Roberts Dissents in 8-1 Standing Decision, Writing “The Least Dangerous Branch Will Become the Least Expensive Source of Legal Advice”

Following oral argument discussing Taylor Swift’s successful lawsuit seeking only $1 in damages, the U.S. Supreme Court this week held that a plaintiff’s demand for nominal damages, as little as $1, satisfies the redressability element for Article III standing where his or her claim is based on a completed violation of a legal right.  Chief Justice Roberts cast a lone dissenting vote for the first time during his 16-year tenure, citing his concern that “the least dangerous branch will become the least expensive source of legal advice.” Read more here.
