HHS Issues Guidance Regarding HIPAA and Same Sex Marriage
Leslie Francis, Associate Dean for Faculty Research & Development College of Law at University of Utah, writes about an important guidance document that clarifies HIPAA protections for spouses in same-sex marriages. This document states that, even if the individual is receiving services in jurisdiction not recognizing same-sex marriage, "spouse" as it applies to HIPAA rights still applies to legally married same-sex spouses.
