As COVID-19 Business Interruption Cases Are Filed, MDL is Considered - Insurance Coverage

With shutdowns still in place, at least in part, in many states, business policyholders nationwide have begun to file suit over denials of coverage for business interruption due to COVID-19. There are currently over 140 such cases pending in federal courts across the country.

Some policyholders have argued that Multidistrict Litigation (MDL) is the most fair and efficient way to handle the factfinding portion of these trials, either in Illinois or Pennsylvania. Other policyholders, insurers, and advocates disagree. The Judicial Panel on Multidistrict Litigation is expected to make a determination near the end of July. Read more from Law360 here.
