Who is the client? What can I share with the insurer? What if the insurer and insured disagree on consultants, strategy or resolution? These questions are part of the longstanding debate as to the duties of an attorney in defending an insured claim. That debate is often focused on whether only the insured or both the insured and the insurer should be viewed as the client and what duties are owed to each.
