Almost every business, organization, or government entity will, at one time or another, have unclaimed property on its books or in its possession. If those unclaimed funds rightfully belong to someone else, the holder may have an obligation to remit the funds to the state. Although not a true tax, states increasingly rely on these funds as an additional source of revenue, and enforcement by contingently-paid third-party auditors is common. This session covers the fundamentals of unclaimed property liability, audit techniques used by states, recent high-profile cases and a changing legislative landscape.
