The Office of Judicial Administration recently proposed amendments to Criminal Rule 2.1 and Trial Rule 3.1 that would require cell phone numbers to be included on appearances. The Indianapolis Bar Association surveyed attorney members on this change and subsequently, through the association's board of directors, submitted the comment below to the Indiana Supreme Court Committee on Rules of Practice and Procedure.

Through the Indiana Supreme Court Committee on Rules of Practice and Procedure, the Office of Judicial Administration has proposed amendments to Criminal Rule 2.1 and Trial Rule 3.1 that would require attorney cell phone numbers to be included in all appearances. In response to concerns by members of the bar, the Indianapolis Bar Association distributed a survey on March 28, 2018 to gauge member reaction to these proposed amendments.

The survey was distributed to 3,511 attorney members and was completed by 43 percent of recipients. Opposition to the amendments was clearly demonstrated in the survey, with 87.4 percent of respondents answering “no” when asked if they supported the rule changes. 7.9 percent of respondents supported the change, and 4.7 percent indicated they had no opinion. 

In light of the overwhelming feedback in opposition to the proposed rule amendments to Criminal Rule 2.1 and Trial Rule 3.1, the Indianapolis Bar Association Board of Directors recommends to the Indiana Supreme Court Committee on Rules of Practice and Procedure that these proposed amendments not be adopted.
