The Sedona Conference recently published its Commentary on Rule 45 Subpoenas to Non-Parties, Second Edition. The Commentary is a project of the Sedona Conference Working Group on Electronic Document Retention and Production (WG1), and it is an update to the 2008 edition. It provides pertinent updates based on amendments to the Federal Rules of Civil Procedure and “significant case law development.”
