Nearly one year ago, the National Labor Relations Board (the "NLRB") issued its decision in Browning-Ferris Industries ("BFI"), thereby shifting the landscape of the joint employer standard (the Department of Labor subsequently issued guidance on the same topic, which DSV previously summarized here.)
