By Hon. Sandra L. Jensen, Natural Resources Commission, Division of Hearings

The Natural Resources Commission (NRC) has proposed a new rule to address representation and party participation in AOPA proceedings before the NRC. The Notice of Intent is available here and the link to offer comments is on the NRC’s Rulemaking Docket here (scroll down to “Participation/Representation in AOPA Proceedings” then across to view current information.) Comments are only accepted through the online link or by regular mail. Presently, this rule is pending review by the State Budget Agency (SBA). The NRC will schedule a public hearing if the rule is received favorably by SBA. The rulemaking docket will be updated periodically as the rule progresses through the process.

Also, on the rulemaking docket is reference to another rulemaking that amended 312 IAC 3-1-7 and 312 IAC 3-1-9 and repealed redundant rules. This rulemaking has already been granted final adoption by the NRC and is pending final review/approval by the Office of the Attorney General and the Governor. These amendments are clearly identifiable on the copy of the rule provided here.
