Welcome to Tip of the Week! Judicial officers will offer a tip each week for members of the Family Law Section. Feel free to send suggestions to Mag. Kim Mattingly at

By Mag. Kimberly Dean Mattingly, Marion Superior Court

Be warned: some retirement plans are now charging administrative fees for processing QDROs. The simplest way to address this potential problem is to address any potential expense in your Settlement Agreement. I have a hearing coming up to address a plan’s $650 fee. We had an attorney conference to chat about it and the lawyers worked hard to get the parties to agree on how to divide the fee, but instead, the parties are going to come in and spend $400-500 each to divide a $650 fee.
And, per judicial officers who are retired military or reserves, it is inappropriate for your clients who are in the military to appear in court in uniform. Pity, since military uniforms are not seen often in central Indiana and they always fascinate
me, but inform your client to be respectful to his or her branch of service and follow the guidelines.

Stay tuned for a new tip next week!
