A direct quote from one of my colleagues: “e-filing may seem instantaneous to you, but it is not to us. If you submit something on the day before a hearing or the day of, we will likely not have it because it still must go through the clerk and our staff. Please call the court to alert the staff of your submission so that they can have the clerk expedite processing. We would especially appreciate your consideration if you are filing a Notice of Settlement because, believe it or not, we also prepare for hearings.” I will add that most of us require some kind of filing in order to vacate a hearing; phone calls indicating a settlement are not sufficient to clear a hearing off the docket.
And, we received word today that attorneys of record now have access to ALL documents in ALL public cases! And, attorneys who have appeared for a party have access to some confidential cases/documents. Here is a new cheatsheet for accessing documents in Odyssey. Enjoy!
