Environmental Law News

Posted on: Oct 26, 2020

There is a virtual hearing scheduled for Wednesday, Oct. 28 to discuss a citizen’s petition on rulemaking. The petition asks the Environmental Rules Board to direct the Indiana Department of Environmental Management (IDEM) to adopt the 2012 Recreational Use Criteria under the Clean Water Act. The board will discuss the hearing at its next meeting, which is scheduled for Wednesday, Nov. 18.

In an Aug. 6, 2020 post, Nick Gahl reported on IDEM’s efforts to update its Remediation Closure Guide (RCG), which was last revised in 2012. IDEM’s Office of Land Quality (OLQ) continues to work on its update, which is referred to as R2. OLQ has received over 300 comments from attorneys and consultants so far and will conduct at least one virtual open forum to continue those discussions.

Special thanks to IDEM General Counsel Nancy King for providing these updates.
