In case you missed it, the Indiana Department of Environmental Management (IDEM) announced that it has a new group of scientists, pulled from places outside the Office of Land Quality, to help with "settling technical disagreements" for Voluntary Remediation and State Cleanup Program sites. IDEM explains that the Panel will make "recommendations" during informal dispute resolution between the usual IDEM technical personnel and the responsible party. IDEM also notes that it does not consider the Panel recommendation an agency action subject to administrative review. For more information on this developing mechanism, go here.
