The subject of electronic discovery issues in litigation has generated significant discussion and debate in recent years, as well as numerous legal decisions. In response, the ABA Electronic Discovery in Bankruptcy Working Group was formed to study and prepare guidelines and a best practices summary on the scope and timing of a party’s obligations to preserve and produce electronically stored information (ESI) in bankruptcy cases. The Commercial & Bankruptcy Section will present a program that will in part address the ABA's suggested procedures, as well as a summary of some of the most relevant rules of civil, bankruptcy, and local procedure. Featured as speakers at this program will be the Hon. Robyn Moberly of the United States Bankruptcy Court for the Southern District of Indiana and Elizabeth Lally of Rubin & Levin PC.
