Trust and estate mediations share many characteristics with family law mediations. People feel more hurt and betrayed when the injury (perceived or real) comes from a family member or loved one. As the saying goes, "there is a fine line between love and hate." Jeffrey N. Fink addresses some of this in his article “Nine Things to Remember When Mediating Inheritance Disputes.” Our own ADR Section is planning a program on trust and estate mediation in August, so take a look at this article for some great information and save the date for our program.
