G. Michael Witte, a well-regarded former judge and the current Executive Secretary of the Indiana Supreme Court Disciplinary Commission, discusses recent cases that highlight various ethical considerations that attorneys often have to wrestle with as they prepare for, and go to, trial. Those considerations include balancing the duty of candor toward the tribunal (regarding both facts and law) while advocating your client’s position, collecting and presenting evidence and navigating potential issues related to temporary admission and unauthorized practice.
