Expungement and Restricted Disclosure of Arrests and Convictions

The Indiana General Assembly passed PL 194-2011 (HEA 1211), allowing individuals to petition courts to restrict access to arrest and conviction records under certain circumstances. The law amends the general expungement statute, IC 35-38-5 by adding section 5.5 (IC 35-38-5-5.5), allowing a person to petition for restriction of arrest records, and it adds a new chapter, IC 35-38-8, which allows a person to petition for restriction of conviction records. This program will explain the new statutory provisions, the requirements for the petitions and how they differ from the general expungement provisions. It will also guide both practitioners and judicial officers handling the petitions through the new procedures.
